Welcome to NexusSwap. These Terms of Service ("Terms") govern your use of the NexusSwap platform, website, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. NexusSwap operates as a non-custodial cryptocurrency exchange platform. We facilitate peer-to-peer cryptocurrency exchanges without holding, controlling, or having access to your funds at any point during the transaction process. Please read these Terms carefully before using our Service. If you do not agree to these Terms, you must not use our Service.

"Platform" refers to the NexusSwap website, API, and all associated services. "User" refers to any individual or entity that accesses or uses the Platform. "Exchange" refers to the process of converting one cryptocurrency to another through our Platform. "Wallet Address" refers to the alphanumeric identifier used to receive cryptocurrency on a blockchain network. "Fixed Rate" refers to an exchange rate that is guaranteed for a limited time period. "Floating Rate" refers to an exchange rate that may change based on market conditions during the exchange process.

NexusSwap provides a non-custodial cryptocurrency exchange service that allows users to exchange one cryptocurrency for another without the need for registration, identity verification, or custody of funds. Our core services include: • Instant cryptocurrency exchanges between supported pairs • Fixed and floating rate options • Real-time exchange rate quotes • Transaction tracking and status updates • API access for programmatic trading We do not provide wallet services, fiat currency exchanges, margin trading, lending, or any services requiring us to hold your funds.

By using our Service, you represent and warrant that: • You are at least 18 years of age or the legal age of majority in your jurisdiction • You have the legal capacity to enter into these Terms • You are not located in, or a citizen or resident of, any jurisdiction where cryptocurrency trading is prohibited • You are not subject to economic sanctions or identified on any list of prohibited parties • Your use of the Service does not violate any applicable law or regulation We reserve the right to restrict access to the Service in any jurisdiction at our sole discretion.

As a user of our Service, you agree to: • Provide accurate and complete information when initiating exchanges • Verify all wallet addresses before confirming transactions • Ensure you have sufficient funds to cover the exchange amount and network fees • Comply with all applicable laws and regulations in your jurisdiction • Not attempt to circumvent any security measures or access restrictions • Not use the Service in any manner that could damage, disable, or impair the Platform You acknowledge that blockchain transactions are irreversible, and we cannot recover funds sent to incorrect addresses.

You may not use our Service for any illegal or unauthorized purpose. Prohibited uses include, but are not limited to: • Money laundering or terrorist financing • Fraud or theft • Circumventing economic sanctions • Processing funds derived from illegal activities • Market manipulation or wash trading • Interfering with or disrupting the Service • Attempting to access other users' accounts or data • Using automated systems to scrape or extract data without authorization We reserve the right to refuse service, terminate accounts, and report suspicious activity to relevant authorities.

Our exchange fees are included in the quoted exchange rate. The rate you see before confirming an exchange is the rate you will receive, excluding network transaction fees. Network fees are charged by the respective blockchain networks and are not controlled by NexusSwap. These fees vary based on network congestion and are deducted from the exchange amount. We do not charge any hidden fees. All applicable fees are displayed before you confirm an exchange. For API users, rate limits and fee structures may vary based on your subscription tier.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not guarantee: • Uninterrupted or error-free operation of the Service • The accuracy of exchange rates or market data • The completion of any specific exchange within a particular timeframe • Protection against losses due to market volatility Cryptocurrency trading involves significant risks, including the potential loss of your entire investment. You should only exchange cryptocurrency that you can afford to lose. We are not responsible for any losses resulting from blockchain network issues, wallet vulnerabilities, or user error.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEXUSSWAP AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability for any claim arising from your use of the Service shall not exceed the fees paid by you for the specific exchange giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless NexusSwap and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: • Your use of the Service • Your violation of these Terms • Your violation of any applicable law or regulation • Your infringement of any third-party rights • Any dispute between you and any third party regarding your use of the Service

We collect minimal data necessary to provide our Service. Our data collection includes: • Exchange transaction details (cryptocurrency types, amounts, wallet addresses) • IP addresses for fraud prevention and security purposes • Browser and device information for platform optimization We do NOT collect: • Personal identification information • Government-issued IDs • Bank account or credit card information • Social security numbers or tax identifiers For complete details on our data practices, please refer to our separate Privacy Policy document. We may share data with law enforcement when legally required to do so.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform.
